HC1 Malfunction

My HC1 that I just purchased on ebay 5 weeks ago, new and unopened, has developed a problem. After about 5 min, it shuts itself off, then turns back on, then shuts back off, ... Anyone know what's wrong with it? Do you think that it would still be under warranty since I bought it unopened, from an individual on ebay (probably not). Any advice on where to send it to get it fixed? This really makes me sick.
